The Fury of Sendong

MISAMIS ORIENTAL

THE RAGE OF nature took Mindanao apparently by surprise.

For the first time in its history as a province, Misamis Oriental succumbed to the fury of Sendong that even Mindanao never faced before. It faced storms only at a rate of one every 12 years. And devastation fell mostly at the city of Cagayan De Oro. But deaths also occur in the nearby Iligan City. As of the latest count (December 21), official death toll runs at 1,002 people, 650 coming from Cagayan De Oro City, and 283 from the nearby Iligan City.
American meteorologist, Jeff Masters, considered the tropical stormed, nicknamed internationally as Washi, as the world's deadliest storm in 2011, surpassing Brazil and Thailand in casualties (902 and 657, respectively).

The United States National Aeronautics and Space Administration (NASA) noted that Sendong already packed 50 millimeters of rainwater a day before it struck on December 16 (Friday). The amount almost equalled that of Ondoy in 2009, but much deadlier to the lives for many factors still under investigation.

So Much Outpour

Reports indicated that the flood rose to 181 meters only in an hour. Thae flashfloods that unleashed along the riversides caught the victims in a sleep they would no longer wake from.

Aftermath

CDO Archbishop Antonio Ledesma called on President Benigno S. Aquino III to create the River Basin Management Council to implement the River Basin Plan to prevent the present scale of devastation to life and property from happening again.

Statement of Retired CJ Hilario Davide Jr on Fate of the Truth Commission

Republic of the Philippines
The Philippine Truth Commission of 2010
(Pursuant to Executive Order No. 1)

I am deeply saddened and pained by the Resolution of the Supreme Court denying with finality the Motion to Reconsider its decision declaring unconstitutional Executive Order No. 1 creating the Philippine Truth Commission of 2010.

It perpetuates its patently wrong and erroneous application of the doctrine of equal protection of the law.

The Resolution could cause the loss of my faith, trust and confidence in the Supreme Court which I had faithfully served for nearly fifteen years; more than seven of which as its Chief Justice.

By its decision and resolution the Supreme Court has made itself an instrument to suppress or prevent the discovery of the truth.

The timing of its promulgation— barely 20 hours after the President delivered his State of the Nation Address where he solemnly declared that the fight against graft and corruption is a personal one for himself and for all the Filipinos who are its victims, and announced the appointment of newly retired SC Justice Conchita Carpio Morales as Ombudsman— clearly proves beyond doubt that the Court has become a protector of some people.

It delayed for several months, and only after the retirement of two Justices who wrote strong dissenting opinions, the release of the resolution which was expected anyway.

But the Supreme Court will not succeed.

For the truth will triumph and prevail despite and inspite of the Supreme Court.

The Administration and the new Ombudsman, Justice Carpio Morales will see to it that it will triumph and prevail.

I only pray to God, the Supreme Judge, that He will help the Supreme Court redeem its honor and integrity.

Senator Santiago Elected First ICC Judge from Developing Nation

MANILA

SENATOR MIRIAM Santiago has a lot of tricks on her sleeves to stop bringing surprises to the Filipino people. This time she aced contenders for a Judge seat in the International Criminal Court (ICC), making her the first woman judge for ICC who came from a developing nation in Asia.

On 12 December 2011, the ICC overwhelmingly elected Santiaugo in New York as a new Judge for the international court, topping the first round of elections with 79 votes out of 104 valid votes. She bested other 18 candidates from various regions.

The Ongpin Investigation

MANILA

Former Marcos trade minister Roberto V. Ongpin found himself in hot waters lately after an alleged behest loan from the Development Bank of the Philippines (DBP) and the Land Bank of the Philippines (LBP) got blown out to the public. The loan was used to buy shares of Philex Mining Corporation, where he used to be its chairman. He is #21 in Forbes' 40 Richest in the Philippines in 2010 with a net worth of $300 million.

The point of investigation centered on the sale of 50 million shares of Philex Mining Corp. that DBP owned. Through DVRI, Ongpin acquired a loan from DBP. Using this loan, another Ongpin company Golden Media purchased the shares from DBP, which it later sold to Twin Rivers of Manuel Pangilinan.

Meanwhile, Pangilinan managed to corner 20.6 percent of Philex shares from other sources on 28 November 2008. With the acquisition of additional shares from DBP, Pangilinan gained control of Philex.

COMPANIES INVOLVED

Global Air Services (GAS). A British Virgin Islands-based company, GAS only had an authorized capital stock of $2. But despite that normally suspicious financial standing, LBP president Gilda Pico admitted that the two banks extended the $180-million loan on 14 December 2008. This gives away an influential hand involved in the approval of this loan, which overrides the expected caution for discretion.

Delta Ventures Resources Inc. (DVRI). Long-time personal secretary Josephine Manalo admitted before the Senate Blue Ribbon Committee that she fronts for businessman Roberto V. Ongpin in obtaining loans from two government financial institutions (GFIs), namely the Development Bank of the Philippines and the Land Bank of the Philippines. Officially, Manalo owned 24,996 shares of DVRI out of the 25,000 shares available, a virtual single proprietorship. On 12 December 2011, she admitted she assumed ownership of record of the shares obtained from the GFIs as far as SEC records are concerned. However, in fact, all these shares have been endorsed to Ongpin.

GF INSTITUTIONS INVOLVED

Development Bank of the Philippines (DBP). Former DBP president Reynaldo David who led the bank when it extended the loans to Ongpin became a member of the board of an Ongpin-led bank, Philippine Bank of Commerce. After testifying before the Senate, he however resigned from the board on December 9.

BEHEST LOAN


INSIDER TRADING

Instead of dumping the DBP shares of Philex Mining to the market, the government-owned bank sold its 50 million shares to a ready buyer in Ongpin at the prevailing market price of P12.75 per share. This comprises 50 percent of DBP holdings in Philex.
In order to purchase these shares, DBP granted Ongpin the first credit accommodation to his DVRI (amounting to P660-million) and Two Rivers of the First Pacific group. This made for DBP a total of P1.397 billion.
Evidence indicated that Ongpin accumulated a block of shares from DBP and others in order to sell it to Pangilinan. Senator Juan Ponce Enrile, whose law firm had been involved in the setting up of Philex, said on record that the transaction between Pangilinan and Ogpin to corner the Philex shares from DBP was already a done deal even before the actual sale of shares to Ongpin’s DVRI. The transactions concluded in Shangri-La Hotel in Makati where he shook hands with Pangilinan for the price of P21 before he was able to accumulate and he never shared this information to DBP, and to the other stock holders.
David testified that even Social Security System president Romulo Neri wanted to sell SSS shares in Philex for the same price. Neri knew that Ongpin sold a block of shares at P21. But that’s too late, Ongpin cornered the market using insider information, Enrile said.
Ongpin’s name however did not appear in documents of DVRI submitted to the joint hearing. Instead, it was Josephine Manalo.

Impeachment of Chief Justice Renato Corona

MANILA

IT IS FINAL. A total of 188 members of the House of Representative signed today the impeachment complaint against Supreme Court Chief Justice Renato Corona.

The complaint centers on eight articles: (1) betrayal of public trust through a track record of marked of marked partiality and subservience involving the Arroyo administration; (2) culpable violation of the Constitution and/or betrayed public trust arising from failure to disclose to the public the statement of assets, liabilities, and networth; (3) culpable violation of the Constitution and/or betrayed public trust by failing to prove competence, integrity, probity, and independence; (4) betrayal of public trust and/or culpable violation of the Constitution arising from the disregard of the principle of separation of powers on the issuance of status quote ante order against the House over the impeachment of resigned Ombudsman Gutierrez; (5) culpable violation of the Constitution through wanton arbitrariness and partiality in consistently disregarding the principle of res judicata and deciding in favor of gerry-mandering in the cases of 16 newly-created citiies and the promotion of Dinagat into a province; (6) betrayal of public trust by arrogating the authority and jurisdiction of the House in investigating an alleged erring member of the Supreme Court; (7) betrayal of public trust through partiality in granting a TRO in favor of FPGMA, and distorting the SC decision on the effectivity of the TRO, and; (8) betrayal of public trust and/or commission of graft and corruption over failure and refusal to account for the judiciary development fund (JDF) and special allowance for the judiciary (SAJ) collections.

While pro-Arroyo supporters may view this exercise as an assault to the integrity of the Supreme Court, most Filipinos view this as a healthy democracy at work where the House performed its Constitution-mandated role in putting a check on the performance of the other two independent branches of government: the Executive and the Judiciary. And the Congressmen who supported this move deserve a strong applause for doing something to resolve the growing problem in the Supreme Court.

Former President GMA Faces Corruption Raps

FORMER PRESIDENT Gloria Macapagal-Arroyo (FPGMA) became the second president who will formally face a day in court for alleged corruption during their administration. The first president to experience this was former President Joseph Ejercity Estrada, ironically under the administration of FPGMA.

The "Wayward Judiciary"

MANILA

SENATOR FRANCIS "Kiko" Pangilinan makes a call on the legislative and executive branches of government to "stand and oppose" the Supreme Court, which he considers a "wayward judiciary."

"No, this is not anarchy," he said on Monday, November 21. "This is democracy at work. This is checks and balances at work. It is the sworn duty of the executive and the legislative departments to act as a check on a wayward judiciary." 

Reflecting the minds of many, if not most, Filipinos, Pangilinan noted how the high court has failed to restore the public confidence of the judiciary, failed to support the government effort to strike down graft and corruption and government, and "courted insubordination and disrespect for its almost-whimsical and arbitrary exercise of judicial authority in a number of recent cases."

Many Filipinos cannot remember a time when the Supreme Court has so lost the confidence of Filipinos for any show of wisdom in its many decisions, not even during the time of the Marcos dictatorship.

Today, the Supreme Court under the leadership of CJ Renato Corona has shown nothing but symptoms of a bastion of high justice that lost its way. Its actuations tinged of politicism; its decisions display its favorable hands towards those powers that put most of its associate justices in position. The blind lady liberty has lost the blinders in her eyes, and now has brandished its powers not to serve true justice and the Filipino people but what political patronage dictates.

In a time when fight for graft and corruption becomes the byword of government, the executive and legislative branches have awakened and grew in their task of joining the fight. And the branch expected to support the fight now puts its political weight to obstruct this fight.

It seems to be that, in order for the fight against graft and corruption succeed, the present Supreme Court must be "destroyed" in the hope that, like the fabled phoenix of old, it will rise again from the ashes into a new creature that sees nothing but to serve the Filipino people, the genuine cause for justice, and free from the contaminants of corrupt values coming from the Old Politics.

The 2007 Election Fraud Scandal

THE JOINT Commission on Election (Comelec)-Department of Justice (DOJ) Committee filed on 18 November 2011 (Friday) a formal charge of poll fraud against former president Gloria Macapagal-Arroyo before the Pasay Regional Trial Court, Branch 112. Included in the charge are co-accused Andal Ampatuan Sr. (former Maguindanao Governor) and Lintang Bedol (an ex-Comelec official in Maguindanao). Judge Jesus Mupas issued a warrant of arrest for the accused.

The Charge

The Committee recommended the filing a charge for electoral sabotage committed on or before 14 May 2007 where the accused conspired and helped each other to ensure a "12-0" victory in the senatorial candidates of Arroyo's "team unity." No bail applies for the charge. It also sought the issuance of a hold departure order to prevent the accused from leaving the country.

The information filed allege a willful, felonious and unlawful tampering of the "provincial certificate of canvass (PCOC) of votes, the statements of votes by city or municipality (SOVM) and summary statement of votes (SSOV) for the province of Maguindanao."

"A few days before the election day during a dinner meeting in Malacañang Palace," the information continued, "accused Gloria Macapagal-Arroyo, personally instructed accused Andal Ampatuan Sr., who was then governor of Maguindanao, to ensure a '12-0' victory for the senatorial candidates of the Team Unity." Ampatuan then instructed accused Atty. Lintang Bedol, then chairman of teh provincial board of canvasser of Maguindanao, to make it happen.

Bedol maneuvered to tamper the PCOC, SOVM, and SSOV adding votes for the 12 Team Unity candidates "ranging from 86,122 to 196,157" votes.

One of America's Most Wanted Captured

David Wayne Altman Greth (39) ran out of his luck when the National Bureau of Investigation Western Visayas Regional Office operatives captured him in Iloilo City where he lately work as an English author in a Korean language school. He came from Portsmouth, Virginia where he faces 11 counts of sexual offenses--rape (1 count), child abuse (2 counts), aggravated sexual battery (2 counts), forcible sodomy (3 counts), among others.

He arrived in the country on 4 August 2006. He stayed sometime in Bacolod City and Capiz, after which he finally settled in Iloilo City. [READ REPORT]

A Whistleblower Fell

CEBU

Bernardo Liu, the whistleblower in a 2001 congressional hearing on a drug syndicate, was found decomposing, even if doused with oil, outside the kitchen of his house in Tangke, Talisay City on 29 September 2011 (Thursday) morning. His body tied in a rope bore no signs of strangulation. But he was gutted out, and a bolo was found near his body.

His neighbors at Naya Subdivision had not seen him for two weeks, making them suspicious. That's time the police found out his dead body. They saw him last on August 30 when his daughter visited him.

In August 2001, Liu testified before the congressional committee on dangerous drugs that Chinese-Cebuano businessmen Peter and Wellington Lim were involved in a drug syndicate known as Hong Kong Triad. He faced a complaint for illegal importation and possession of drugs after he admitted at the congressional inquiry that he ran drugs for the Lim brothers in Hong Kong. Liu’s buddy who also worked for the Lims, Ananias Dy, was gunned down on July 8, 2006 in Katipunan, Cebu City.

Libyan Embassy Defected to Rebel Camp

MANILA

After rebels stormed on 23 August 2011 (Wednesday) the fortress-like compound of Muammar Khadaffi in Bab al-Aziziya in Tripoli, diplomats in the Libyan embassy in Manila defected to the rebels, destroying images of the hiding leader and raising the rebel flag. Consul Faraj Zarrough heads the Libyan mission in the Philippines.

The National Transitional Council, the interim rebel government, will administer government until a new leader gets elected through a democratic process.

The ICC Rome Statute Ratified

MANILA

The Senate ratified on 24 August 2011 (Thursday) the Rome Statute of the International Criminal Court (ICC) 13 years after the Philippines helped draft the treaty in 1988 during the administration of late president Corazon Aquino. The ICC is a permanent tribunal created on 2 July 2002 to prosecute individuals for genocide, crime against humanity, war crimes and crimes of aggression.

Under the treaty, the ICC can step in when countries are unwilling or unable to dispense justice for the crimes it covers.

“If a state becomes a party to the Rome Statute," Senator Miriam Defensor-Santiago said, "any past leader could be investigated and prosecuted if he committed a core crime, particularly if he is the head of state, member of the national legislature, or government official at a similarly high level.” She said that the Rome Statute was the most important innovation since the founding of the United Nations.

On 23 August 2011 (Tuesday), the newly-acquired BRP Marcelo Del Pilar reached the Philippines from the United States of America, replacing the World War II-era destroyer as the country's flagship. The refurbished Hamilton-class cutter is a 46-year-old vessel that the US Coast Guard recently decommissioned.

The Preused Ravens Helicopters Controversy

THE SENATE Blue Ribbon Committee as of this writing continue its investigation on the controversial P105-million purchase of three helicopters, two of which had been allegedly owned and used by former First Gentleman Jose Miguel "Mike" Arroyo, that the Philippine National Police (PNP) made in 2009.

Asian Spirit; Lion Air. Owned by Archibald Po. Purportedly the exclusive distributor of the Raven helicopters manufactured by Robinsons.
Manila Aerospace Trading Corporation. President: Hilario de Vera. The exclusive marketing arm of Asian Spirit and Lion Air.
LTA Incorporated. President and Chairman: FG Jose Miguel Arroyo.

ARROYO STAND
Arroyo maintains that he does not own the two used Raven helicopters.
      
TESTIMONIAL EVIDENCES
1. Sia Testimony: LTA sent a total of $1.5 million to Robinsons Helicopter (California) for the purchase of five Raven helicopters from late 2003 to early 2004. [Renato Sia is the general manager of Lion Air]
2. Solano-Juguan Testimony: For the past seven years she went to the LTA office every month to receive money in cash for the maintenance and other operating expenses for the four helicopters, two of which had been sold to the PNP. The fifth had earlier crashed. In these visits she would exchange pleasantries with former FG while she counted money given by Rowena del Rosario (LTA accountant). [Edith Solano-Juguan is an employee of Lion Air.]
3. Lazo Testimony: He received instructions through text from Mr. Arroyo on who should be allowed to use the helicopters and their destinations. [Domingo Lazo is a Lion Air dispatcher.]
4. Silvestre & Labastilla Testimonies: They piloted the helicopters with Mr. Arroyo and members of teh Arroyo family as passengers in 2004. They would usually land at an exclusive Malacañang helipad. [Dennis Silvestre and Margarito Labastilla are pilots of Lion Air.]

DOCUMENTARY EVIDENCES
1. LTA Telephone Numbers: AThe telephone numbers written on the documents at SEC and the $500,000 Banco de Oro direct wire transfer from LTA Inc. are the same. The LTA Incorporated SEC registration papers showed its telepone number as 8172709. The telephone number on top of the BDO Herrera branch direct wire transfer made on 11 December 2009 to Robins (a faxed copy sent to Lion Air) is also 8172709.

Senator Miguel Zubiri Resigned

MANILA

On the wake of a renewed investigation on the poll cheating in the 2007 national elections, Senator Miguel Zubiri announced his resignation on 3 August 2011 (Wednesday) from the Senate "because of these unfounded accusations against me and these issues has systematically divided our nation and has casted doubt in our electoral system which has affected not only myself, this Institution, but the public as well."

In that election, Zubiri got over 11 million votes placing him on the 12th slot for Senate, ahead of his closest rival, lawyer Aquilino Pimentel III, son of former senator Aquilino Pimentel Jr. Pimentel however contested the result before the Senate Electoral Tribunal over alleged irregularities and cheating in the controversial elections. The protest remained pending since 2007 until mid-year this year.

From the Past: Malacañang Bonifacio Hall

Formerly the Premier Guest House, the Bonifacio Hall was built in 1975. It is the glass fronted building across the garden from the the main entrance of Malacañang Palace.

The frontal part of the building that faces the garden is a two-story high reception area, with a staircase in the center that leads to the corridor above.

History

American Governor Generals built the Bonifacio Hall as servants' quarters to screen off Malacañang from San Miguel Brewery that used to be next door. A remodelling touched it in 1975 to have it useful for the IMF-World Bank Boards of Governors Meeting that year. A reconstruction occurred from 1978 through 1979. But when fire hit the Palace in 1982, another reconstruction work becomes necessary. In 1983, its air purification system went through an improvement.

A 1970s earthquake survey found it vulnerable, but nothing had been done to correct it since then. In June 2011, president Benigno S. Aquino III had it repaired for good.

Late strongman Ferdinand E. Marcos (1965-1985) used it as a guest house, late president Corazon C. Aquino (1986-1992) and her successor president Fidel Ramos (1992-1998) used it as an office, and former president Joseph Ejercito Estrada (1998-2001) used it as his residence.

Unknowingly, late president Aquino used for office the bedroom of late president Marcos at that when Ninoy was assassinated in 1983.

Zamboanga City Prosecutor Won Human Trafficking Hero Award

ZAMBOANGA DEL SUR

Assistant city prosecutor, Darlene Pajarito of Zamboanga City received on 29 June 2011 (Wednesday) from United States Secretary of State Hillary Clinton the Global Trafficking in Persons Hero Award for her outstanding performance in successfully prosecuting the highest number of human trafficking cases in the Philippines. Clinto presented the award at the 2011 Global Report on Trafficking in Persons held in Washington DC, USA.

This blog reported in an earlier entry on the extent of Pajarito's performance in her crusade against human trafficking as a prosecutor in the Mindanao city.

Marcos Burial Issue Long Settled

In a decision that marks with great wisdom, President Benigno S. Aquino III upheld the settlement that the administration of former president Fidel Ramos entered with the Marcoses on the burial of the late strongman's remains in Ilocos Norte, with full military honors, and not in the Libingan ng Mga Bayani.

The Pajero 7

MANILA

Margarito Juico, the new Philippine Charity Sweepstakes Office (PCSO) chairman, revealed that the government agency is verifying reports that former president Gloria Macapagal-Arroyo used its funds to get the support of a number of bishops, among which were seven prelates who received Mitsubishi Pajero vehicles, before she stepped down from office in 2010. Allies of Arroyo in the previous PCSO Board had left the agency with some P4 billion in debt.

Juico said that P6.9 million of PCSO fund was allocated for the purchase of five to six utility vehicles supposedly given to the Archdiocese of Cotabato, Zamboanga, Caritas Nueva Segovia, Basilan and Butuan from February to July 2009.

"Malacañang Diocese"
All Catholic bishops know the members of the so-called Malacañang Diocese, the members of which could be the same prelates referred to as the Pajero Seven. These bishops supposedly receive grants from the Arroyo administration, including vehicles and projects. Talks of this "new" diocese came up during the controversial moments of the Arroyo administration's turbulent years, such as the Hello Garci controversy and the anomalous $329-Million ZTE Deal.
During these political ordeals, the Philippine Amusement and Gaming Corporation (Pagcor) reportedly offered cash donations to Catholic bishops ranging from P300,000 to P500,000. Three archbishops--Ricardo Cardinal Vidal, archbishop of Cebu; Angel Lagdameo, and; Paciano Aniceto, archbishop of Pampanga--returned the checks.
Teodoro Bacani, bishop Emeritus of Novaliches, confirmed that the Arroyo administration resorted to corruption to soften the stance of the Catholic bishops, and to "divide and conquer" the Church.

The Pueblos Letter

ARCHDIOCESE OF OZAMIS
Fr. Marvin Osmeña, custodian of the archdiocesan property, denied that the bishop received a Mitsubishi Pajero from the Arroyo administration.

ARCHDIOCESE OF BUTUAN
Bishop Juan de Dios Pueblos admitted on July 6 (Wednesday) that he sent a letter to former president Gloria Macapagal-Arroyo asking for "a vehicle" that he could use for his community service. The Pajero SUV he received as a birthday gift through PCSO was worth P1.7 million.

Motel-Like Accomodations at the New Bilibid Prison

MUNTINLUPA

Well, it is not just one but 150 motel-like tiled huts that house moneyed convicts at the New Bilibid Prison in Muntinlupa City.

The members of the House committee on justice found that out on 7 June 2011 when they did an occular inspection in controversial "cells". Visiting the site were representatives Niel Tupas Jr. of Iloilo (committee chair), Rufus Rodriguez of Cagayan De Oro (member), Elpidio Barzaga Jr. of Cavite (member), Rodolfo Biazon of Muntinlupa (member), and Magtanggol Gunigundo of Valenzuela (member). 

Inmates have the keys
The rooms have their own toilet and bath, with one inmate living in each room. And to top it all the inmates have their own key for their respective rooms. Not even the prison guards have a duplicate key of these rooms. Its a vacation accomodation for drug lord convicts and moneyed inmates.

A Stark Contrast
Despite the bemoaned bad conditions of prisoners in NBP, it is not difficult to understand how the posh accomodation of moneyed inmates contrasted that of the poor who had to stay with fellow prisons in a single cell.

GOCC Governance Act of 2011 Becomes Law

Republic Act 10149, or the GOCC Governance Act of 2011, came into law today as President Benigno Aquino III signed it, overhauling the compensation system of the entire GOCC and removing excessive salaries, allowances, and other perks of their heads and board members.

Term of Office
The new law limits the office terms of officials into one  year. In addition, the term of office of all appointed incumbent heads and board members of GOCCs will end by June 30, 2011 unless they are reappointed or a replacement is appointed sooner by the President.

Governance Commission
The law also creates the Governance Commission of the GOCCs that will oversee the coordination and implication of government policies in these state corporations.

GOCC Website
The law requires all GOCCs to maintain a website that will allow the public free access of its financial statements.

Exclusion
The Act excludes the central bank, state universities and colleges, cooperatives, local water districts, and research institutions.

VIEWS

The Gutierrez Impeachment Trial

Statements

Senator Juan Ponce Enrile, president, Senate: "As a citizen of this republic, I am really not happy with the performance of the Ombudsman and her people... (So) I understood where the President is coming from when he issued those statements because he was getting frustrated and wants to do something."


Impact

The positive impacts of the impeachment trial include:
1. Evidences will be put in the court of law on whether there is basis for the accusations made upon Guttierez.
2. The Filipino people can move on in cleaning up the government of corrupt employees.
3. Evidences on the unsettled legal issues involving the Arroyo administration will be evaluated for their merits in the impeachment court.

There only two important outcome that can weigh on the country because of the trial:
1. The cost of the trial will be very high.
2. A long stretched out trial can derail the other works of the Senate and can be troubling for the people to follow.

UPDATE: Merci Resigned

In a letter dated 29 April 2011, Merceditas Guttierez tendered her resignation to PNoy, effective May 6. On the same day, the President accepted it.

Impacts

One central outcome of the Gutierrez resignation is the automatic discontinuation of the impeachment trial.

Positive Impact to Gutierrez
1. She will save herself the trouble of defending herself from the court.
2. She removed the risk of probably losing the case, including her retirement benefits and right to serve again in the government.

Positive Impact to those Involved in the Scams Mentioned
1. The case will not be scrutinized and deliberated anymore in the impeachment court, keeping the status quo. (If protectionism had happened, those being protected remained so at least for the meantime.)

Positive Impact to the Government
1. It saves millions of pesos of expenditures for the impeachment trial.
2. It allows Senators to more on to other national concerns.
3. It removes in the Office of the Ombudsman the obstacle to cleaning up the government ranks.
4. The Filipino people can finally move on from this issue.

Negative Impact
The sole negative outcome this event brought was the opportunity loss at not having the controversies hounding the Arroyo administration scrutinized in the court of law.

The Controversial Province of Dinagat

SURIGAO DEL NORTE

Background
In 2006, less than a year before the 2007 election, President Gloria Macapagal-Arroyo signed into law Republic Act 9355, creating the new province of Dinagat Island to comprise the entire Dinagat Island. It is composed of four 4th class and three 5th class districts. It is one of the two provinces that the Arroyo administration as, according to a Newsbreak report, to her political allies in the island--the Ecleos.

The new law expressly stated that the Province "contains an approximate land area of 80,212 has or 802.12 sq. kms, R.A. No. 9355, therefore, failed to comply with the land area requirement of 2,000 sq. kilometers."

From these facts, the Supreme Court (SC) ruled in February 2010 that the creation of the Province of Dinagat Island was unconstitutional because it failed to comply with the requirements of the Local Government Code, Section 461, which states demands that a province may only be created when it has an average annual income of not less than P20 million and a population of 250,000 or a contiguous territory of 2,000 square meters.

Based on the 2000 Census of Population from the National Statistics Office available at that time, Dinagat Island had only 106,951 inhabitants. Even by 2007, it had only a population of 120,812.

Associate Justice Diosdado Peralta penned the 2010 SC decision.

Later on, the Office of the Solicitor General and Dinagat Island Governor Geraldine Ecleo Villaroman separately filed a motion for consideration, which SC denied, affirming its decision on the case with finality.

SC Flip-flapped Anew
On 29 March 2011 (Tuesday), the present SC issued a ruling reversing the 2010 SC decision. This time Associate Justice Antonio Eduardo Nachura penned the decision. According to Newsbreak, "It is unclear why the SC reopened the case."

The Banco Filipino Debacle

On 12 March 2011, the Philippine Stock Exchange (PSE) effectively delisted thrift bank Banco Filipino Savings and Mortgage Bank (BF) for "continuous violation" of disclosure rules and failing to submit structured reports. At least for two succeeding years, the bank failed to submit at least an annual report to the bourse.

In the 1980s, the Central Bank of the Philippines, under the Marcos regime closed the bank, supposedly done so arbitrarily. Then the Supreme Court ordered it opened in 1994. The rebuilding plan that the Makati Regional Trial Court approved in November 2010 required that BSP infuse P25 billion in financial assistance to BF. BSP however appealed the order to the Court of Appeals.  BF later filed a complaint for contempt against BSP. BSP filed an injunction case at the Court of Appeals.

On 28 March 2011, BSP revealed that the bank suddenly listed Perfecto Yasay Jr., a former chairman of the Securities and Exchange Commission, as its vice chairman, replacing Albert Aguirre. Since the recent bank holiday, only Yasay came forward to defend publicly the thrift bank, claiming it had more than P30 billion assets.

History

Banco Filipino got established in 1964, founded by Tomas Aguirre. The Aquirre family controlled the thrift bank. It innovated in 1965 to become the first all-woman bank, making it a hit. In 1969 it became the first bank to process online transactions in real time, giving customers the ability to deposit in any online BF branch. Since 1966 until its closure in 1985, BF was the largest savings bank in the Philippines.

In 1972, BF grew and was voted the most preferred bank in Metro Manila in 1975. By 1981, it had 89 branches, four billion pesos worth of assets, three million customers and three thousand shareholders.

But on 23 July 1984 BF declared a self-imposed bank holiday due to illiquidity. CBP did not order it closed immediately but placed it under conservatorship a week after the declaration. The central bank infused P3 billion pesos as a credit to help it. After six months of examination and supervision, the BSP released the supervision and examination (SES) report on 23 January 1985.

At the recommendation of the report, the Central Bank of the Philippines closed the bank on January 25 on the basis of illiquidity and insolvency. For most of the 1980s it remained closed until the Supreme Court declared in 1991 the bank's closure as illegal. The Court found the report was based on incomplete findings. It subsequently opened in 1994 with only 15 branches out of its original 92 branches.

In 1996, the Philippine Stock Exchanged relisted it in the bourse.

The Supreme Court in 1999 declaired that BF was entitled to damages payments because of its illegal closure.

In 2002, BSP extended P3.5 billion worth of emergency loan to Banco Filipino, of which P2.6 billion is still outstanding.

Current Condition

Bank examiners found out that Banco Filipino has been posting losses averaging P2 billion a year from 2007 to 2009, which reached to about a monthly loss of P277 million last in the first nine months of 2010. As of December 2010, it incurred P12 billion in losses. BF executive vice president and corporate secretary Francisco Rivera admitted that the bank continued to lose anywhere between P800 million to P900 million a year since it reopened in 1994. This ongoing bleeding of its finances may have been the reason it stopped filing financial reports to the PSE, resulting to its recenting delisting in the bourse.

Aside from interest payments amounting to P1 billion a year, BF has been incurring huge expenses after it paid compensation of P500 million or 2.5 times its gross income and legal fees amounting to P131 million in the third quarter of 2010 alone. More than half of the bank's outstanding loans amounting to P4.1 billion was extended to entities of directors, officer, stockholders and related interest (DOSRI). The 900 million emergency loan from the BSP in 2002 may as well have been swallowed in this DOSRI loans.

As of 10 September 2010, 91 percent of the bank's total loans became past due, which meant their principal and interest remained unpaid 30 days after their due date. Of this uncollected overdue loans, more than half (P2.2 billion) had been loaned to DOSRI.

BSP also revealed that it paid salaries, benefits, and professional fees (SBF) more than its gross income. Between 2007 and 2009, BF averaged an annual gross income of P242.5 million, but its SBF expenses amounted to P597 million a year, or 2.5 times more than its annual gross income.

BF also owed BSP about P4.4 billion in past-due loans as of September 2010.

The BSP pointed out in its comment to the Court of Appeals filed in April 5 that Banco Filipino was insolvent as it had P8.4 billion more liabilities than assets.

Voluntary Closure

On 15 March 2011 (Tuesday), BF voluntarily closed its branches from depositors without prior notice. Only the assigned guards can be found in branch premises, who in turn told bewildered depositors that the employees have not reported to work.

Information coming from an insider in a Dumaguete branch indicated that the employees received on March 14 (Monday) at 11:00 PM not to report to the bank the following day.

Two days later, the BSP ordered the closure of BF, and placed it under the receivership of Philippine Deposit Insurance Corp. (PDIC). BSP said that its liabilities topped its assets by P8.4 million. It had gathered evidence showing the bank's top officers mismanaged their depositors' money.

Banking Practices

Nestor Espenilla Jr., deputy governor of the Bangko Sentral ng Pilipinas (BSP), said that BF engaged in high-risk, high-yield schemes to attrack depositors, such as offering 14 percent interest on deposits despite the fact that other banks offer 1-2 percent only.

Because of the dismal income performance, BF lured depositors with interest rates way above prevailing market rates. While most banks pay interest of 1-2 percent for special savings deposits, BF paid so much more--from 6-13.9 percent. This result to its interest expense higher than its interest income. Between 2007 and 2009, it averaged a negative net interest margin of P1 billion a year.

BSP also disclosed that a big chunk of BF assets were actually losses that had been capitalized.

In its 170-page comment filed with the Court of Appeals on April 5, BSP said that BF operated a Ponzi scheme. Instead of investing the deposits, the savings bank used these to pay the interest of old deposits and for the daily operations. Named after its originator Charles Ponzi who made it notorious in early 1920, a Ponzi scheme is "a fraudulent investment operation that pays returns to separate investors, not from any actual profit earned but from their own money or money paid by subsequent investors," The Philippine Star reported. This resulted into a dismal performance of P242.5 million in average gross income that cannot serve its average interest expense of P1.1 billion.

New Smuggling MO: Liquefied Cocaine

MANILA

Agents of the National Bureau of Investigation (NBI) arrested three suspected drug mules and confiscated 2.25 liters of liquefied cocaine (equivalent to 2.25 kilos of dry cocaine) at the Ninoy Aquino International Airport (NAIA). Cocaine exposed toa air will solidify. The items are worth an estimated P10 million. This is the first time that Philippine authorities came across the product.

Those arrested are Than Thuy Ngoc (Vietnamese, 26) and two Filipinos acting as drug mules--Carmelita Daisy Bustamante (Cambodia, Tagum City, 45) and Maria Britannical Maldo Diño (San Francisco Del Monte, Quezon City, 28).

Bustamante was arrested at NAIA Terminal 1 en route to Thailand on board Thai Airways on 11 March 2011. She carried the liquefied cocaine inside two separate shampoo containers. No apparatus in the country can detect the presence of liquefied cocaine. She was supposed to deliver the items to Diño who will deliver it to Ngoc at a hotel in Manila.

According to NBI Director Magtanggol Gatdula, "this is a new modus operandi, and this is the first in the country."

More Drug Mules Arrested

On March 17 in Bacoor, Cavite, NBI agents arrested four foreigners for recruiting Filipino drug couriers. They are Dickson Bola Akinbode (Nigeria, 41), Ousmane Diouma Bah (Africa, 44), Bathshegi Thato Lazarus (Botswania, 23), and Ade Femi Adeleke (Africa, 22).

Forfeiture Case Vs. Tan Companies

In a case filed in July 1987, the Philippine Government (PH) pursued business tycoon Lucio Tan on allegations that some of his companies have stocks forming part of the ill-gotten wealth of the late President Ferdinand Marcos.

The companies involved in the case include Asia Brewer Inc., Allied Banking Corp., Foremost Farms, Himmel Industries Inc., Grandspan Development Corp., Silangan Holdings Inc., Dominium Realth and Construction Corp., Shareholdings Inc., and Fortune Tobacco Corp. (FTC). 

Fortune Tobacco Corp.

The state alleged that 60 percent of the FTC stocks are actually part of the Marcos ill-gotten wealth.

In 2010, a new tobacco company, Philip Morris Fortune Tobacco Corp. Inc. (PMFTCI), was created as a joint venture between Philip Morris (50.4%) and Fortune Tobacco Corp. (49.6%). Tan sits as chairman of both FTC and PHFTCI. The new venture has caused confusion on the part of the prosecutors who alleged that the new venture instead was a merger, dissolving FTC in the process. But the Sandiganbayan disagreed.

House Voted Overwhelmingly to Impeach Guitierrez

The House of Representatives voted on 21 March 2011 (Monday) to impeach current Ombudsman chief Merceditas Gutierrez. And they did it overwhelmingly so.

Innuendos

Pork SMS. The plenary debates on House Resolution 1089 started at 5 PM. Representative Edcel Lagman (Lakas Kampi CMD-Albay) sought to stop the voting and asked the chamber to investigate text messages that circulated among lawmakers over the weekend that allegedly threatening them of being deprived of pork barrel funds if they do not vote in favor of the impeachment. Malacañang issued an official statement that it is not the policy of the administration to use the pork barrel to force congressmen to vote for the impeachment.

Senior Majority Leader Neptali Gonzales II (Mandaluyong) said that the text message came from Representative Emilio Abaya (Cavite), who in turn strongly denied it as a mere disinformation. Speaker Feliciano Belmonte also received the text message. The text message read: "Fr, Cong. Abaya-Favor kindly disseminate to all reps - LP and non-LPs. Thisshud b made clear to all. Those who will vote no or absent/abstain on empeachment will get 0 as in zero. At least walang sisihan that there was no forewarning..." Belmonte had initiated an investigation to identify the true sender.

To prevent Gutierrez supporters from delaying the proceedings, Gonzales motioned to start the consideration of the committee report, and Deputy Speaker Arnulfo Puentevella ordered so at past 6 PM.

INC. House members who received the calls confirmed that a high-ranking official of influential Iglesia ni Cristo (INC) called them asking to kill the impeachment of Gutierrez. Rodante Marcoleta (Alagad partylist), the only INC member in the House clarified that "it is never its policy to dictate on the House members. If indeed the calls were made, it was to urge the lawmakers and appeal to them to vote based on evidence, conviction and conscience."  

The Vote

To have the Articles of Impeachment, including the Committee Report 778 of the House Committee on Justice, sent to the Senate for trial, the House needs 95 votes.

Abstained. 4 Representatives (1.5%) | Speaker Feliciano Belmonte Jr. (LP-Quezon City), Lani Mercado-Revilla (Lakas Kampi CMD-Cavite), Mark Villar (NP-Las Piñas) | Both Revilla and Villar appeared to abstain because both have family members as current senators who will be acting as Judge-Senators once the impeachment case begins trial in the Senate.

No Vote. The 22 representatives who did not register their vote included Imelda Marcos (KBL-Ilocos Norte) and Manny Pacquiao (LP-Saranggani).

The National Peoples' Coalition (NPC), Nacionalista Party (NP) and the Liberal Party (LP) voted as a bloc. NPC and LP voted YES, while NP voted NO.

Ampatuan Murderers Abused Three Women

In his testimony on 10 March 2011 (Thursday), Dean Cabrera, police medico-legal officer, told the court female victim Cecille Lechonsito may have been sexually abused before she was killed in Maguindanao on 23 November 2009. He found 2 contusions found in her vaginal wall may have resulted from "penetration or contact of a hard object."

On 8 December last year, Cabrera said Rahima Palawan, cousin of Maguindanao Governor Esmael "Toto" Mangudadatu, may have been sexually abused based on swabs obtained from her genitals and underwear on November 25, 2 days after the massacre. The tests showed semen present in the samples, which shows direct evidence of sexual abuse or intercourse.

Cabrera also examined the body of journalist Leah Dalmacio and found traces of semen in her body and her panty liner.

In the Ampatuan town of Maguindanao, 58 people were massacred in what came to be known as the infamous 2009 Maguindanao Massacre.

House Justice Committee Voted Probable Cause on Merci Impeachment

The Justice Committee of the House of Representatives voted on 8 March 2011 (Tuesday) in favor of finding probable cause to impeach Ombudsman Merceditas Gutierrez. Thirty-nine members voted in favor, nine voted against, and one abstained.

The voting came after the Supreme Court issued a ruling today junking Merci's appeal to stop the House from proceeding with her impeachment. House Speaker Feliciano Belmonte Jr. texted Ilocos Norte Representative Rodolfo Fariñas to report the ruling while the voting was ongoing.

SC Voting

Five justices voted to let the House panel continute with its hearings. Five ruled in favor of Gutierrez. Two partially concurred with the majority. And one inhibited from the court deliberations.

Not in favor. Those who maintained that the House be allowed to continue the impeachment hearings are Senior Associate Justice Antonio Carpio, Associate Justice Conchita Carpio-Morales, Associate Justice Ma. Lourdes Sereno, Associate Justice Roberto Abad, Associate Justice Jose Catral Mendoza, Associate Justice Eduardo Nachura, and Associate Justice Martin Villarama Jr.

In favor. Those favored the Gutierrez petition are Chief Justice Renato Corona, Associate Justice Arturo Brion, Associate Justice Lucas Bersamin, Associate Justice Leonardo-De Castro, and Associate Justice Diosdado Peralta.

Partially Not in favor. Those who partiallo supported the position of the majority are Associate Justice Mariano Del Castillo and Associate Justice Jose Perez.

Inhibited. Associate Justice Presbitero Velasco Jr. did not attend the deliberation as his son, Marinduque Representative Lord Allan Velasco, belongs to the House justice committee.

UPDATE

The Senate Blue Ribbon Committee headed by Senator Teofisto Guingona III recommended in its 65-page report that Gutierrez "be held accountable for non-feasance." It also recommended to the House of Representative "to submit to the Senate the articles of impeachment against Gutierrez the soonest time possible," The Philippine Star reported on 10 March 2011.

Philippines Broke Guinness Record on Planted Tree Set By India

Under Governor Lray Villafuerte, the El Verde 12 Million Trees by 2012 Movement set on 23 February 2011 the new Guinness World of Records for Most Planted Trees Simultaneously. More than 70,000 people from various sectors of society converged in Siruma, Camarines Sur to plant 64,096 trees in just 15 minutes, and 500,000 trees in one hour, beating India's previous record of 50,033 planted trees in 15 minutes set on 10 October 2010.

At 11:00 AM, the people grouped together in the first and the biggest environmental conservation movement in the country. At exactly 4:30 PM, Guinness World of Records Adjudicator Seyda Subasi-Geminici announced that ehey have achieved the new world record.

VP Binay Wins Amnesty From Kuwait and UAE

MANILA
Vice President returned home on 5 March 2011 (Saturday) from his trip to the Middle East after obtaining amnesty to nearly 300 Filipinos being held there on minor offenses.

Around 279 Filipinos will be repatriated from Kuwait. Most of them were runaways from their employers who had been charged with breach of contract and other minor offenses. The Filipino Workers Resource Center had them in custody. Another 13 Filipinos now under detention will be granted pardon.

Some 80 Filipinos charged with minor crimes in Dubai and Abu Dhabi were also in the process of being repatriated to the Philippines. [Full report]

Last of WWII Bombs Detonated

Using a radio-firing device from atop a hill 1.5 kilometer away, President Aquino on Saturday detonated the last of 4,146 bombs left over from World War II. These bombs could kill people within 32 kilometers of an island in Manila Bay where they had lain forgotten for decades.

After the ordnance were rendered safe, they were transported to the Crow Valley bombing range here in 16 trucks in February. The bombs were blasted in batches beginning Feb. 9 with the last of the lot fired on 5 March 2011 (Saturday) by the President during the close of the joint explosive ordnance operations between Philippine and US troops.

The bombs were buried in lahar and detonated at Crow Valley, which used to be a live firing range of the US Air Force until 1991. The area had been used during war games by Philippine and US troops under the Visiting Forces Agreement.

Clouds of gray smoke billowed skyward after Mr. Aquino pushed the detonator.

The President said the vintage bombs were brought to his attention in August last year. They included depth charges and antisubmarine rockets. [Excerpt from the Philippine Daily Inquirer report]
